Ovington Pottery Studio Participation Waiver & Release of Liability

By participating in classes, workshops, memberships, open studio sessions, or other activities at Ovington Pottery ("the Studio"), I acknowledge and agree to the following:

Assumption of Risk

I understand that ceramics, pottery and related studio activities (including wheel throwing, handbuilding, trimming, glazing, kiln firing, lifting materials, cleaning, and the use of pottery tools and equipment)involve inherent risks of injury. These risks may include, but are not limited to, cuts, burns, repetitive motion injuries, exposure to dust and chemicals, slips, falls, equipment-related injuries, and other unforeseen accidents.

I voluntarily assume all risks associated with my participation, whether known or unknown, including risks that may arise from the ordinary negligence of Ovington Pottery, its owners, instructors, staff, volunteers, other participants, or third parties.

Release of Liability

To the fullest extent permitted by law, I release, waive, and discharge Ovington Pottery, its owners, instructors, employees, contractors, volunteers, and agents from any and all claims, liabilities, demands, or causes of action arising out of or relating to my participation in Studio activities, including claims for personal injury, illness, death, property damage, or loss of personal belongings, whether caused by the ordinary negligence of Ovington Pottery or otherwise, excluding claims resulting from gross negligence or willful misconduct.

Medical Conditions and Personal Responsibility

I certify that I am physically able to participate in Studio activities.

I agree to inform Studio staff of any medical conditions, allergies, injuries, or physical limitations that could affect my participation.

I understand that Ovington Pottery does not provide medical services and is not responsible for providing medical care in the event of an illness or injury.

Indemnification

I agree to indemnify, defend, and hold harmless Ovington Pottery, its owners, instructors, employees, contractors, volunteers, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from my actions, omissions, or failure to comply with Studio policies while participating in Studio activities.

Studio Safety and Conduct

I agree to follow all Studio policies, posted safety rules, and instructions provided by Studio staff.

This includes the safe and proper use of pottery wheels, kilns, tools, glazes, chemicals, equipment, and shared workspaces.

I understand that unsafe behavior, misuse of equipment, or failure to follow Studio policies may result in my removal from the Studio or dismissal from a class or membership without refund.

Personal Property

I understand that I am responsible for my own personal belongings while at the Studio.

Ovington Pottery is not responsible for the loss, theft, or damage of personal property, tools, finished work, or other belongings brought into or left at the Studio.

I agree to clearly label my work, tools, and personal items whenever applicable.

Damage to Studio Property

I understand that I may be held financially responsible for damage I cause to Studio equipment, tools, furniture, or facilities resulting from misuse, negligence, or intentional conduct beyond normal wear and tear.

Artwork and Fired Pieces

Ceramics are inherently unpredictable, and cracking, warping, glaze defects, kiln damage, or breakage may occur during drying, firing, handling, or storage.

While Ovington Pottery will make every reasonable effort to care for my work, I understand and accept that the Studio cannot guarantee successful results and is not responsible for damage to or loss of ceramic pieces due to the normal risks associated with the ceramic process.

Minors and Guests

Participants under the age of 18 must have this waiver signed by a parent or legal guardian before participating.

Guests and visitors are permitted only with Studio approval and must be accompanied by a registered member or student at all times.

Waiver of claims

I understand that this agreement is intended to be as broad and inclusive as permitted by applicable law. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
